To consider and, if thought fit, to approve and adopt the following Resolution:
That the Authority do promote in the session of Parliament 2006/07 a Bill for the purpose of enacting the following amongst other provisions:
(a) provisions for the regulation of vessels in the navigation area described in the Norfolk and Suffolk Broads Act 1988 (“the navigation area”) by means of general directions given by the Authority, and special directions given by the navigation officer of the Authority (“the navigation officer”), together with provisions for the giving of directions as to the loading and unloading of certain kinds of goods;
(b) provisions for the safety of vessels in the navigation area and on waters (“adjacent waters”) connected to the navigation area: including powers for the Authority to make byelaws for the registration of vessels; to impose standards relating to the construction and equipment of vessels and to establish a standards appeal panel; and to impose insurance requirements for vessels;
(c) other provisions for the control of vessels in the navigation area and on adjacent waters: including powers for authorised officers of the Authority to enter and inspect vessels; to require in certain circumstances the evacuation and removal of vessels; to take action in respect of certain vessels; to obtain information as to vessels from masters or owners, and from the owners and occupiers of land comprised in or adjoining the navigation area or adjacent waters where vessels are moored;
(d) provisions for the entry by officers of the Authority on adjacent waters and other land for the purposes of determining whether certain powers in relation to vessels should be exercised, and for exercising those powers;
(e) provisions for the licensing of vessels to be used as rescue boats in the navigation area or on adjacent waters;
(f) provisions for the control of water skiing and wake boarding in the navigation area by a system of zones to be designated by resolution of the Authority: including provisions for requiring persons intending to carry out water skiing and wake boarding to obtain permits from the Authority; and prohibiting such activities otherwise than in a designated zone;
(g) miscellaneous provisions: including provisions for the definition of personal water craft for the purposes of the Bill and other legislation; defining references to vessels in existing byelaws of the Authority; incorporating within the navigation area the areas known as Breydon Water and the Lower Bure; amending legislation as to Haddiscoe Cut; powers for the Authority to supply information to public authorities and other persons; to enforce certain anti-pollution provisions of the Water Resources Act 1991; for removing or requiring the removal of vegetation endangering or obstructing the passage of vessels in the navigation area; and provisions transferring to the Authority the powers of local authorities, under the Public Health Acts Amendment Act 1907, to license pleasure boats in the navigation area and on adjacent waters;
(h) various amendments to the Norfolk and Suffolk Broads Act 1988: including amendments as to the bodies to be consulted by the Secretary of State when appointing members of the Authority; requiring the Authority to manage the Broads in accordance with the principles of sustainable development; conferring powers to carry out, and incur expenditure on, works of improvement and maintenance in relation to adjacent waters; amendments to the provisions relating to the navigation committee of the Authority including its terms of reference; for the appointment of a single navigation officer, in place of the separate Broads and Norwich navigation officers, and regarding the functions exercisable by the navigation officer; amendments changing the financial and accounting powers and duties of the Authority; replacing the duty of the Authority to issue a code of practice for drainage works with a discretionary power; and amendments to the provisions for the removal of wrecks including their extension to unserviceable vessels;
(i) provisions of a general and administrative nature consequential upon or incidental to the foregoing purposes, including transitional provisions and savings;
and for the repeal of certain local statutory provisions; and also for the purpose (if deemed expedient to promote the Bill) of passing such additional resolutions as may be necessary or expedient in connection with the promotion of the Bill
