Code of Practice for Parish and Town Councils

The Broads Authority is committed to supporting working partnerships with the Town and Parish Councils within its area.  We recognise that you have an important part to play in the delivery and overall effectiveness of the development management and enforcement functions and value your input. 

Notification of planning applications


We will:
  •  aim to provide you with a copy of all valid applications to be determined by the Broads Authority within your parish within 5 working days of their receipt. 
  • send you by post or by email link copies of all accompanying drawings/other relevant information, and will include details of the Broads planning officer dealing with the application. 
  • allow 21 days from the receipt of the application in order for you to comment
  • only determine applications and issue the decision notice after the consultation period has expired. 
  • exceptionally, consider any reasonable request made by you for an extension of this time (for example, in order to allow wider consideration of a major  application) at the discretion of the Director of Planning and Strategy and where the determination of the application will not be delayed.
  • appreciate your response within the stated deadline to enable your input to any discussions.
  • endeavour to make available a member of its planning service where you feel it would be of assistance to have the details of a proposal/development explained to your Members.
  • make available details of all new planning applications on the Broads website.

Revised/Amended Plans

We will:

  • send you details of a proposal where an applicant makes an amendment which materially alters the nature of the scheme, and give you 10 working days to reply.
  • seek a new planning application on the occasions where an amendment is requested after a decision has been made which would result in a material change. 
  •  send you for your information a copy of the amended details and the accompanying letter where an amendment is considered to be minor, and acceptable and does not require a new application.

Planning Decisions

We will:

  • determine all applications in accordance with our published Scheme of Delegation.
  • send you a copy of the planning decision on applications determined within your parish.  This will include details of all conditions, and will assist you in monitoring details of the application, including its commencement, or any possible breaches.
  • In the case of applications referred to Planning Committee, include your views in full within the agenda.  If received after printing, they will either be tabled or reported verbally.
  • where an application is reported to planning committee, give you or your Parish Council representative the opportunity to attend and make representations in accordance with the published Scheme of Public speaking.
  • Where an application is deferred for a site visit, invite you or your Parish Council representative to attend the site visit.

Enforcement  - Procedures and Service Standards

We will:

  • deal with complaints or notifications of breaches of Planning Control received directly from you in accordance with the published Enforcement Code of Practice. 
  • notify you in writing of the action that we have taken or are taking in respect of valid breaches of planning control within your parish, which will include details of the Broads Authority officer dealing with the matter, and their contact details.
  •  notify you of cases within your parish where no further action is taken, and an explanation as to the reason/s for this.

Appeals (Planning & Enforcement)

We will :

  • aim to notify you of all appeals relating to applications within your parish within 5 working days of their receipt.
